“Serious Behavior”: Boston judge found ice field agents in sight after a man's detention
A Boston judge dismissed the criminal case Monday against a person detained by U.S. immigration and customs enforcement custody and found a federal agent suspected of tempting court for “serious conduct.”
Wilson Martell-Lebron appeared on the first day of the trial at Edward W. Brooke Courthouse in Boston on Thursday, accusing him of providing false information about the permit application.
Defense attorney Murat Erkan told the newspaper that plainclothes hockey agents detained Martell-Lebron while leaving the court, placed him in an unmarked SUV and drove away.

Boston City Court Judge Mark Summerville accused ICE of “obstructing justice.” He also found that ice sheet agent Brian Sullivan “conspired in a premeditated manner” to detain Martell-Lebron instead of returning him to court.
Summerville claimed that Sullivan “intentionally” and “undoubtedly” violated the rights of Martell-Lebron, protected by the Sixth and 14th Amendments of the U.S. Constitution, and found him tempted to court.
“I found that the court could not trust the ICE to return the defendant to the court. I don't think they were trustworthy,” Somerville said. “I don't have confidence in Ice, no matter what they told the federal government, and they'll bring the defendant to court.”
Somerville turned the matter to the Suffolk District Attorney's Office while searching for Sullivan in the Temperance Court and left it to the DA's office to determine whether Sullivan would face charges.
“We will see this serious behavior taken by the Suffolk County District Attorney's Office and their actions in this regard, and whether any investigation has been conducted and whether any prosecutions have continued,” Somerville said. “My hands are not there right now.”
Somerville also dismissed the case against Martel LeBron for misconduct by prosecutors.
“I think this situation is a necessary condition to stop this misconduct in the future and to stop the federal team from prosecuting the group for such misconduct,” Somerville said. “I found Icefield Agent Brian Sullivan was a member of the prosecution panel.”
The DA's office said in a statement that it was “dismay and surprising” to learn that Martell-Lebron's detention.
“We became one of the safest cities in the United States by pursuing the moral prosecution of keeping criminals accountable and treating victims with dignity,” the DA's office said. “We were frustrated and surprised when our indictment of Wilson Martell-Lebron was arrested by ICE.”
DA's office said once Martell-Lebron's detention was learned and a motion was filed to require him to appear at the trial.
DA's office explained: “Any claim we realize is wrong to try to prevent Mr. Martell LeBron from exercising his power of trial. “The federal authorities should not detain him, but interfere in our efforts to hold him accountable. ”
James Borghesani of the Suffolk District Attorney’s Office told reporters that prosecutors were not aware of the ICE’s plan to arrest Martell-Lebron.
“We participate in any allegations of misconduct or any act of removing the defendants are wrong and reckless,” Borghesani said. “Now this is an extraordinary exposure with Ice, it's a different world.”
Borghesani also confirmed that the DA's office will “seriously investigate” Summerville's request to investigate Agent Sullivan.
